The ACLU issued a press release Tuesday with a copy of a letter sent to the City of Scottsbluff. In the letter, ACLU Nebraska Legal Director Amy Miller cited an ordinance, 13-3-9, which prohibits against "clairvoyance, fortune telling and divination."
According Miller's letter, a citizen contacted the group with concerns whether anyone could be prosecuted under the law. The non-profit organization contacted the city to warn that the law is unconstitutional.
"No matter what your personal opinion about Tarot cards or fortune telling, the right to free speech protects the right of people to engage in those activities," Miller said. "The Eighth Circuit Court of Appeals struck down Lincoln's ordinance against paranormal business in 1998, finding there was no compelling reason for the government to limit fortune telling. That means Scottsbluff needs to change their local ordinance, and we've reached out to them to make sure they're aware of the law."
